The article L. 541-10-9-1 of the French Environmental Code, introduced by the Law of 8 July 2026 and applicable since 10 July 2026, extends the principle of appointing an authorized representative to additional Extended Producer Responsibility (EPR) schemes. Until now, this requirement mainly applied to batteries and electrical and electronic equipment (EEE), and will soon also apply to professional packaging, for which the entry into force is still scheduled for 1 January 2027.
Which EPR schemes will now be concerned?
Following this regulatory development, a total of 19 EPR schemes are now covered by the possibility or obligation to appoint an authorised representative:
- DIY and gardening items,
- Sporting and leisure goods,
- Recreational and sports boats,
- Construction products and materials used in the building sector,
- Batteries,
- Sharps medical devices used by patients administering their own treatment,
- Furniture and furnishing éléments,
- Household packaging and graphic papers,
- Professional packaging,
- Electrical and electronic equipment,
- Lubricating oils,
- Toys,
- Unused medicines,
- Tyres,
- Contents and containers of chemical products,
- Tobacco products,
- Single-use sanitary textiles: wipes,
- Clothing textiles, household linen and footwear,
- Passenger cars, vans, motor vehicles with two or three wheels, and quadricycles.
